LaDonna's Surrogates part 4

Show Notes

The Rise and Fall of LaDonna’s Loudest Surrogate: David McClam

LaDonna Humphrey’s most vocal supporter, David McClam, launched the We Are Not Afraid podcast to defend her against mounting accusations. Episode after episode, McClam promised to deliver proof that LaDonna’s critics were lying.

But instead of delivering proof, McClam brought Alecia Lockhart’s alleged sexual abuser on air to dismiss her claims, issued personal threats to show up at my doorstep and attack me, and even threatened to send the anti-gay hate group Westboro Baptist Church to Anthony Christopher’s gay club for a "blood bath."

This erratic behavior ultimately led to his podcast being pulled down from his hosting provider.

Speaker: For those of you at home not following along closely on Reddit or my social media, LaDonna's surrogate David McClam launched a rebuttal podcast aimed at disproving my series on LaDonna Humphrey. The podcast is called We Are Not Afraid. The We Are Not Afraid podcast is nothing but character assassinations, distraction tactics, and an attempt to re victimize LaDonna Humphrey's accusers who have come forward, who have come forward with their stories. And while I tried my best to ignore this podcast, it just won't, it just won't go away. And while I tried my best to ignore this podcast, it just won't go away GRAMMAR MISTAKES Nobody tunes in to the We Are Not Afraid podcast for their flawless subject verb agreements or their grammatical somersaults. Now, how he did that is, The quality is not what my podcasts usually are, No, they tune in because they want to hear David McClam, LaDonna Zamboni, try to smooth over all the allegations made against her. In each episode, David McClam promises to bring, quote, the proof that my podcast and everyone who has spoken out against LaDonna are lying. So we're going to bring more truth amidst the lies that are being told by Javier Lever. Well, I just told you what the truth is, If you really want the truth, it's there for you. montage of proof overlaying with split channels And I've given you proof behind it we all have proof of that I have unequivocal proof that everything that they've said is a lie again. and I'm going to give you a mountain of proof I will come and provide the proof. You ain't gave no proof. want to wait for me to give you the proof you can find all the proof that I have for yourself. There's your proof. He is mad because I have the proof he is lying and I've given you proof behind it. We have all the proof. We getting it. unequivocal proof And I have receipts on that. Just to prove to you what a witch hunt this is. Episode after episode, David McClam offers proof, but there was no proof to be found. Actually, I was kind of hoping that there was some proof, even just a little bit of proof. After all, I don't expect my reporting to be perfect, but After all, I don't expect my After all, I don't expect my reporting to be perfect, and I am happy to revise anything that I got wrong. But, I listened, and listened, and listened. And that proof never showed up? Just a bunch of empty claims with nothing to back them up. Instead of addressing the allegations raised in my series, LaDonna Humphrey and David McClam took it upon themselves to respond to allegations that I never even made. In today's episode, we are going to talk about, in today's episode, we're going to talk about the rise and fall of LaDonna's loudest surrogate. His name, David McClam. In today's episode, we are going to talk about the rise and fall of LaDonna's loudest surrogate, David McClam. I'm Javier Leyva, and this is Pretend. Stories about real people pretending to be someone else. I'm tired of being called a surrogate. I'm not a surrogate. If you want to know the, uh, oh, oh, oh, oh, oh, oh, let me, let me just back up. Let me give you all of it first so you get the whole thing. Her surrogates It's speaking for her because she's writing and posting Dennis McCaslin's articles. but David, you are her surrogate. By definition, a surrogate is someone who steps in to represent or act on behalf of another person. In this case, LaDonna Humphrey. Maybe David thinks that LaDonna chose him because he's a podcasting pioneer. But maybe David thinks that LaDonna chose him because he's a podcasting pioneer. YOUTUBE INTERVIEWS I did create the YouTube, I didn't say YouTube podcasting. See, this is why you guys don't listen. I said, I created the way that certain YouTubers now do their interviews. Go back 15 years. There was nobody that did YouTube interviews the way that I did them. I had people contact me to train them. Yes, the man thinks that he invented YouTube podcasting. But the truth is that LaDonna Humphrey chose you because she simply needed someone to do her dirty work for her. Why? Because LaDonna Humphrey has a permanent injunction which prevents her from, quote, bullying, harassing, intimidating, or otherwise annoying Anthony Christopher, his attorney, or anyone included in the lawsuit, including Anthony's employees and family like I said, this podcast is a missed opportunity for LaDonna Humphrey to lay out her side of the story, even if it is with her imperfect surrogate, even if it is with an imperfect surrogate. Instead Instead, they chose to dodge the most serious allegations and pointed their fingers at their accusers. For example, Oasis of Northwest Arkansas, LaDonna's sober living facility, was accepting monetary donations for eight years without tax exempt status. David McClam never offered a logical explanation for this. Instead, he pointed out that ReVamp, an organization run by Patty Rush, Was also in the wrong Oh, and just to let you know, revamp, I think is the name is. Why don't you go ask Patty Russ why she's not compliant with the charities board Let me put this in a way that David McClam can understand. Patti Rush is not the subject of my investigation. LaDonna is. HOMOPHOBIC The We Are Not Afraid podcast is is not only trying to misdirect its audience about the most serious accusations, they're also fixated on disproving even the most obscure claims. In episode three of my series, you heard LaDonna addressing allegations that she called the executive director of an organization Anthony Christopher worked for and outed Anthony's sexuality

Ladonna: And in the lawsuit, they say, They named this in the lawsuit and they say that I, um, called Anthony a faggot, and I did not,

Detective: you just said alternative lifestyle is what you said.

Ladonna: I I wouldn't have used the word faggot. I may have said homosexual.

Speaker: So, in one of the very first episodes of the We Are Not Afraid podcast, David McClam went out of his way to bring on their token gay friend did we treat you any different, give you any type of vibes, like you were yucky to us, did we treat you like a normal person? Oh, God, not different at all. And it's really easy to tell that, you know, like you get. You get used to the side eye glances or, you know, the, People kind of intentionally not calling your wife, your wife, um, or, you know, they'll passively, aggressively give you some sort of Bible, something or other. Um, and I never experienced that from any of y'all. This is Kai Penfield, host of the Stand Your Ground Podcast. Um, I even, like, LaDonna asked if she could take my wife and I out to dinner and talked about how sick, how excited she was to meet my wife. Which was completely unnecessary because she hasn't been working with my wife. She's just been working with me So I kind of identify as gray asexual, which means, um, I don't experience sexual attraction to people I'm not like emotionally involved in, and then I would be homoromantic. Out of all the accusations, this is what they focused on. The We Are Not Afraid Podcasts is all smoke and mirrors. They brought this person a character. They brought this person as a character witness to prove that LaDonna is not homophobic. Yeah. Well, and I mean, there's definitely different levels, I think, of homophobia, but I would put LaDonna at level zero as an, I can't talk. I would put LaDonna at level zero as in no homophobia. And the idea that she would call someone the F word is so absurd to me because I think she used, I think she said shit in front of me and then immediately apologized for it. I was like, you're fine. You're an adult. We're all adult. I wasn't trying to prove Ladonna's acceptance of the L-G-B-T-Q community or. Or that she called Anthony, quote, a fag, I was simply, I was simply playing a clip demonstrating that LaDonna Humphrey is willing to leverage Anthony Christopher's sexuality to get him fired. I was simply playing a clip demonstrating that LaDonna Humphrey weaponized Anthony Christopher's sexuality to get him fired She's an incredible person. And it, it makes me really sad that people are trying to elevate themselves by listening to voices with unverified facts about someone who has done so much good. And rather than trying to verify those, trying to find the truth, they're willing to just. Spread gossip and spread rumors that are not only hurting LaDonna, but they're hurting all of the cases that LaDonna has helped work on Maybe Kai Penfield was misled and doesn't know all the details about this case. So, I called her up. INSERT KIAH'S INTERVIEW

Javier: I'm just so curious about you and your side of the story because I first learned about you when I heard you on the, on David McClam's, We Are Not Afraid podcast.

Kiah Penfield: Yeah, yeah. Um,

Javier: that. How did that come to be?

Speaker: The Murder Case and Podcast Beginnings

Kiah Penfield: yeah, so that I, I guess I feel like I should back up and explain kind of how I got involved LaDonna in the first place, um, which is, um, Um, my cousin was murdered in June of 2017 in Escambia County, Florida.

Speaker: So I was like, trying to find somebody to cover this. And, you know, nobody was covering it. Nobody was covering it. so I was trying to find anybody who would maybe come on my podcast to look at evidence or anyone who would have me on there so that I could talk about the case and try and get more awareness. Um, and that's where I found David's podcast so that's kind of how I got involved with David and LaDonna. Um, it very quickly became like LaDonna was super invested in the case she talked at one point about writing a book about the case. She talked at one point about doing a documentary about the case. And I was like, fantastic. Like we need more people to pay attention. So that's how I met or how I got involved with Dave and LaDonna And then yeah, I met LaDonna face to face for the first time at Nashville Tri Con

Kiah Penfield: That, um, news about your podcast broke, we were in talks about doing, um, the book.

Speaker: she was very distraught. and so then, at a certain point, it was brought up of like, maybe, a podcast or something where like each episode is a different podcaster in the true crime world that's like doing the defending for you

Javier: eventually though, you, I think, accepted the, the role of like, possibly doing something with the podcast, We Are Not Afraid, right?

Kiah Penfield: yeah, so initially David, um, texted me and was like, so we are going to do this podcast. Uh, LaDonna wants me to do it. LaDonna wants you co host it. Um, and I was like, yeah, sign me up, totally. Um, and then, what made me uncomfortable was then he was like, So, you know, we'll host it, LaDonna will write the scripts.

Javier: but what what was your vision for the podcast? Like what were you thinking? It was gonna be about

Kiah Penfield: my thought was honestly just that we were going to, the way it was pitched to me originally was you would release an episode. We would then do the research, figure out whether or not those claims were substantiated or exaggerated, or, you know, we all put on the way we

Javier: but it's a reaction to the episode So if I replace one then you'd be like, well, they said this this part might be right. This part is

Kiah Penfield: Right.

Speaker: it was supposed to be that, and then it didn't.

Javier: Have you listened to

Kiah Penfield: I listened to the beginning of it and then I Oh God. And then I stopped listening to it because I was like, I. I just have regret.

Javier: if I were LaDonna, I would rather you be the spokesperson than David McClam just because of his lack of eloquence

Speaker: It seems like it's just a shouting match, just some angry person yelling into a microphone with no direction. yeah, Um, and so I can't imagine that LaDonna, uh, listens to that and it's like, yeah, we got them. You know, like I imagine her cringing every time she listens to that episode or if she even listens, like

Kiah Penfield: have idea.

Javier: it's really hard to listen to it. Like I don't even think she could get through an episode. It's so unhinged.

Kiah Penfield: have no idea.

Javier: Well, so at some point you, it sounds like you changed your mind. How did, what, what happened that caused that and how did you back out of the deal?

Speaker: hmm.

Kiah Penfield: Had this feeling in the back of my mind of I'm going to start this and then I'm at some point Going to feel stuck and have regrets.

Speaker: First we heard from Lexie Kakas that LaDonna was recruiting people to be her mouthpiece on the We Are Not Afraid podcast. Now we learn from Kai that she was also approached and accepted the offer. So two separate people told me that LaDonna Humphrey approached them about starting the We Are Not Afraid podcast on her behalf. But David insists that LaDonna Humphrey has nothing to do with this I got a screenshot from Kai. The message is from David and he's explaining to Kai how the show is going to work. He says, we have this idea to do a podcast debunking this guy's episode by episode. We have this idea to do a podcast debunking this guy episode by episode. We could call it Let's Not Pretend. She wants you and I to host it and she will write the scripts. Would you like that? She will write the scripts. LaDonna Humphrey. This is evidence right here that LaDonna Humphrey was the mastermind behind the We Are Not Afraid podcast. She's writing the scripts. which, I don't know, it seems like, uh, she violated that permanent injunction against her. She's not writing my show, she doesn't control me, she's not having sex with me, I have a wife for that, she is not paying any of my bills. LaDonna Humphrey simply is just my friend. I will give this disclaimer since it's been out here forever, but Donna Humphrey has nothing to do with. We are not afraid podcast. She doesn't write any episodes for me. She doesn't tell me what to say. Uh, she hasn't forced me to do this. This is something that I have done on my own. This is what my platform is. And if somebody's being wrong, no matter who they are. I'm going to come and defend them. However, just in this case, it just happens to be a very good friend of mine who was actually my best friend And I'm going to say this one more goddamn time. Javier Anthony, Christopher, Zali Duncan, whoever else is listening to this. LaDonna Humphrey has nothing to do with what I say, what I produce or anything else. We're not afraid Dennis McCaslin and part of my friends has told you guys to all kiss his ass. He's also told you. She doesn't write anything. I've told you since I produced my podcast, she ain't y'all. It was kind of interesting watching David McClam slowly implode during the production of the We Are Not Afraid podcast. In the first few episodes, he had a bit of a pep in his step. You know? A sense of arrogance about him. But then But then the reddit trolls started going after him. He began to be But then the But then the reddit trolls started going after him and he began to be But then the reddit trolls started going after him and he began to be But then the reddit trolls started going after him and he began But then the Reddit trolls started going after him, and he began to get more and more unhinged. First, he recruited Tom Stockland, Ladonna's attorney, to send me a cease and desist letter. But that wasn't enough I have lawyers at the ready. and then that one lawyer turned into three lawyers, Remember I told you that I think I said I had three lawyers, which I did listen to that episode. Well, since then I had another lawyer and another cop, and those four lawyers turned into even more lawyers SEVEN ATTORNEYS I have about seven different attorneys who's already written me that wants to help me sue the Reddit thread and also Reddit because Reddit has been told before it is in violation of their terms of service. I don't want you guys to think that that is a joke. They are harassing LaDonna Humphrey. They have been harassing me. And now they are harassing my wife. and he's right. Some of the people on the LaDonna Humphrey Talks subreddit have been brutal to David McClam. One user in particular, who goes by the name. One user in particular who goes by the screen name MartyBase seems fixated on David McClam. He says he's seen pictures of the outside of McClam's house and even calls it a hovel. This user posts daily comments on the multiple RVs in the trailers outside McClam's front yard. But what really gets under his skin is the fact that this user constantly talks about David's multiple marriages. He refers to the current wife as wife number five. I was beginning to wonder if this person was real. Why is this, why is this Marty, why is this Marty Bass going after David McClam so hard? And why does he know so much about his personal life? It seems like this user always is the first to post when a new We Are Not Afraid podcast episode drops. The more this user taunted David, the more unhinged We Are Not Afraid episodes got. The more this user taunted David, the more unhinged David McClam got. Could this user be LaDonna Humphrey? I mean, winding this guy up so that he continues to defend her? After all, McClam's complained After all, David McClam complains about getting After all, David McClam has famously said that he also gets unwanted messages. that he also gets unwanted messages. What a weird strategy. So one day, this Reddit user, Marty Base, emails me and I replied and asked him if he would be open to an interview. If I could talk to this person and, if I could talk to this person, maybe I could determine if he's real or To my surprise, Marty Base said yes. Marty Bass 20241002 1513_R: Hello, Meet Marty Bass. That's not his real name, by the way. My first question was, why are you so obsessed with David McClam?

Javier: basically I just wanted to talk with you I don't know if I actually want to do anything with it, but I am curious about because i've seen you know Some of the things you've written and about david. I'm very curious about your experience with him I know what you've written about but just to kind of get a little bit more insight

Speaker: Marty Bass 20241002 1513_R: Uh, alright, the short version is, I talk a lot, so if I ramble on, feel free to be rude and tell me to shut up, because, I'm not making any fools. Okay, the deal is, why I gotta, in 30 seconds or less, why do I have an axe to grind with David. Is that, where we want

Javier: basically, yeah, that's where I want to start

Speaker: Marty Bass 20241002 1513_R: Alright, the short version is, I discover Dave. In March of this year with the extinguished podcast, they covered the Deanna Stevenson case, which was out of Florida. Short version is There was no short version, but David McClam and LaDonna Humphrey covered the Deanna Stephenson case on their other podcast, Extinguished. And David accused two people involved with the case of being suspects. Marty Bass 20241002 1513_R: I wrote him an email saying hey, like, I get it, you know, most podcasts they go allegedly or possibly, he said no, these other two chicks absolutely had trigger time, even though they were victims. And I thought that was BS, and I wrote him a detailed. Email explaining why I thought it was BS. David McClam read Marty's email on the air. Marty Bass 20241002 1513_R: and basically calling me a kook, which is okay, because I probably am. It's also important to note that the Deanna Stevenson case is the subject of Kai Penfield's podcast, Stand Your Ground. Kai, of course, is who you heard from earlier. She tells me that Marty Bass is obsessed with the Stevenson case and even has, and she even accuses him, and she even accuses Marty Bass of harassing her Y'all, this dude named Marty is, um, sharing my cousin's son's name online. We've been trying to keep it private cause he was a minor at the time. He very likely is sending mail to people on both sides of the murder using the COVID 19 testing system. Can't prove it. Can't figure out who else it could have been. Okay, it sounds like this Marty Bass guy has had beef with McClam for some time now. But this guy sure knows a lot about David McClam's personal life. Is he stalking David and his wife?

Javier: how do you know how do you know so much about them that's what I

Speaker: Marty Bass 20241002 1513_R: dude. I do. I used to be smart. I used to be smart. And I got a lot of time on my hands. And I just Google the shit. And I just I go down the trail like she sells jams, she makes uh, jewelry, pencils, she's hustling her ass off. They have a menagerie there, I think she's, they've got four or five dogs, they're constantly picking up strays, that I picked off of Facebook. I mean,

Javier: Is she have a does she have public Facebook? Is that how you

Speaker: Marty Bass 20241002 1513_R: yeah, because I don't have Facebook because I got banned a long time ago because, You know, of my wonderful comments, Marty Bace doesn't deny that he's a troll. He sounds like he wears the title with pride, but he says he's not a stalker. He's just looking at publicly available information, Facebook, Facebook stalking, if you will. Marty Bace just wants to know why David McClam is hell bent on defending LaDonna Humphrey.. Marty Bass 20241002 1513_R: they've known each other less than three years He's willing to take a bullet for but he got his wife begging on Facebook to get a ride from here Yeah, I mean it just does any of that make sense to you. I want to know what the attraction is and I feel sorry for his damn wife. Cause you're, you know, she's tired of hearing LaDonna's name. Uh, well, I mean, you know, you're wrapped up all this time. You're on the phone talking this bitch off the ledge cause she's suicidal four days a week. Where's her husband? I mean, like, why is this all? All in your lap. MURRAY LaDonna Hunt for here and I've got Amy Smith with me. Hey, guys, and, um, unfortunately, we have to do this as a recording because there has been a lot of talk about whether or not, um, the text messages that were sent to James Renner regarding let's bring them home and the reward that we offered and then rescinded were. actually genuine. And so we've got a couple of board members, former board members from Let's Bring Them Home on this recording with us. And we're going to call them M and T. We're not going to use their real names because we're trying to protect them from the trolls. JOHN ALLEN So, why am I talking about all this? It's not to make fun of David McClam for his poor grammar or his outrageous rants. I took the painful task of listening to every episode of We Are Not Afraid to demonstrate to you how dangerous this show is and why I am responsible for taking it down. Like I said earlier, We Are Not Afraid is not just a vehicle to tarnish the reputations of the people accusing LaDonna Humphrey of harassment. It's designed to instill fear in the hearts of the people who are speaking out against her, like Pastor John Allen's family.

Ladonna Humphrey: Well, when you called today, I thought, I drive a red Suburban. And I'd seen, I thought, he's telling them I burned his house down. That's exactly what I said. Is

Investigator: that why you asked, am I in trouble?

Speaker: Yes. John Hughes Allen was a dangerous and frightening man. I hear the spiritual abuse that took place at Lake Hill's church was severe and damaged many lives. Not only did they miss an opportunity to address the actual allegations, they actively tried to further humiliate LaDonna's accusers. Like the time David McClam called up the man Alicia Lockhart claimed sexually assaulted her CHRIS CORNER But I don't want you to just take my word for it or rely solely on what LaDonna Humphrey and Alicia Lockhart have written and strangled. I want you to hear from the producer himself about the movie he made with Alicia. Listen in as he contradicts Alicia's entire story in detail. Hey, Chris, thank you for coming on the show today is a pleasure to talk to you. Oh, it's my pleasure too. Thanks for hitting me up and so we can, uh, get this stuff straight. I remember when this episode came out and Alicia couldn't even bear reading the transcripts. It was gross just to put, it was gross, just to put it lightly You might think that LaDonna and David are giving this death fetish director a platform to speak out about his side of the story, but in reality, all they're doing is re victimizing Alicia. And she answered an ad for, you know, basically for a model and she said she wasn't really comfortable doing modeling. And I was like, well, you know, I could really use a hand around here, Now she's also stated that she felt like you had a crush on her, that you would continuously flirt with her when she was at the office. Is any of that true? Um, I've, I mean, I've flirted with everybody, but it wasn't in a, in a sexual manner. It was just, I'm just nice. I'm, you know, I'm not as charming as I used to be, but I kind of was back then, you know? So Alicia claims on her first shift that you asked her off the bat to be in a porn film. Was that true? Mm Yeah, I mean, well, I guess, yeah, I mean, I asked her to be in a fetish film, I just gave her a job because I kind of felt bad for her and her situation. You know, and, you know, she had this car payment or whatever, and she had to make and, and I never, I never like made advances on her or even, you know, yeah, like I might've flirted or said she looked nice or something like that people in the death fetish community are all about fantasy. They don't, you know, I'm sure 99. 9 percent of them don't want to harm a fly. That's kind of my, I'm sorry. It's kind of, you know, I'm like kind of almost laughing because. And I'm not trying to make light of, of anyone who actually has been assaulted or anything like that, because I'm an advocate for women and I always have been. And, you know, I grew up in a beauty shop, you know, folding towels and hanging out with the ladies and whatever. Oh, it doesn't stop there. David McClam took it upon himself to threaten me and Anthony Christopher. Let's play the tape. THREATS let me show you how dangerous I could be. I know exactly where Javier Labo lives. If this was 25 years ago, Dave, Javier Labo would have woke up to me standing on his doorstep. Oh, I've done it to trolls before. how would Javier react if I showed up at his doorstep? And knock on his door and he opens the door and all six foot four and a half, two ninety standing there and I look at him and say, now, what else do you have to say? It could happen. but I'm not showing up to have a conversation. You're going to open the door, I'm going to snatch you directly out of your house, and I'm going to commence to whipping your ass. That was 25 year ago, Dave. That's a very different Dave now. And a couple of years later, I'm the one that's taking the stand that violence doesn't get you anywhere. David tries to mask these threats by saying that he's older and wiser now. He doesn't justify violence. Then why the hell are you saying these things on your podcast? He continued to threaten, he continued to threaten to show up at my home in North Carolina. He continued to threaten to show up at my home in North Carolina. you don't know me. You're in North Carolina. I'm here. I have a lot of family on North Carolina. I'm just letting you know that I know the power in which I have. I know the power of a phone call and what it can do. So what stops me from calling my family members? Someone that lives within miles of where Javier Label lives. And say, this dude is harassing me, go pay him a visit. And I told y'all, man, 51 year old Dave ain't about the violence. And I know that those family members that I know are not going to show up to talk to Javier Leyva, Javier Leyva would have ended up hurt. When I tell you, you don't know who I am, or you don't know me at all. I'm telling you, you don't know what my past was, who I'm connected to. Then he threatened to send the Westboro Baptist Church to Eureka Springs, Arkansas to a gay bar owned by Anthony Christopher. I know the power of a particular church that is completely against gay people. That they're so against it that they use a derogatory term about it. And they actually have a website that that's what their URL is. It was reached out. Over three months ago by them that they were aware of a gay drag queen named Anthony Christopher. That is lying and trying to take down a very well based Arkansas author. After LaDonna successfully destroyed his career as a mental health professional. Anthony Christopher moved to Eureka Springs and purchased a nightclub called Eureka Live. Every weekend, hundreds of tourists and regulars attend a drag show. I experienced my first drag show at Eureka Live during my visit to Arkansas. It was a blast. People of all kinds were there. Old men with veteran hats, straight couples, gay couples, you name it. We all were having a great time. And that's why I'm so alarmed when I listen to David McClam threaten to send an anti gay church whose URL is godhatesfags. com to attack the performers and patrons of this club. And patrons of this club And they were ready to mobilize all over you. We collide. It was an email. They gave the Eureka Live address. They said, you know, this is Anthony Christopher's nightclub. We're ready to move Don't think for a second, though, it did not cross my mind to pick up my keyboard and to write them and say mobilize, but I did not. You know why? Because no matter how I feel about anybody being gay or my religious beliefs, that is hate. all it would take, is for somebody who was gay, or dressed in drag, or they figured out was transgender to come out and approach them, it would have been a bloodbath.

Javier: How do you feel now that that has happened? Knowing that. That David McClam has threatened to send the Westboro Baptist Church to have a bloodbath at Anthony's gay club. Like how do you feel as somebody as part of the LGBTQ community that you were, I felt like you were used personally.

Kiah Penfield: I, yeah, I want to be clear too, but like, first thing when I saw, and like I said, I had stopped listening to his podcast. I wasn't really listening to yours. So, um, when you contacted me and you were like, yo, he said this, I was like, Oh, lovely. Um, my first kind of thought was, uh, like the pulse shooting,

Speaker: um, and

Javier: Like a what?

Kiah Penfield: the pulse shooting, the pulse

Javier: oh yes, yes, yes, yes,

Speaker: This was so outrageous that even Marty Bass, who is a self proclaimed troll, couldn't believe what he was hearing. Marty Bass 20241002 1513_R: And I would be the first one if I saw somebody saying, Hey, David, I'm coming to your house to do something. I'd be like, whoa, whoa, neg. You know that, that, that's not cool. You know what I mean? Like, you know, if you want to, if you wanna talk a little smack, that's one thing. But, I mean, today's episode, I mean, 20, Dave, uh, 20 years ago would have been at your door. And, I mean, and he doesn't even, he's not even smart enough to, like, code it. He said flat out, if I showed up at your house, I'm whooping your ass. Is that not what you heard?

Javier: Yeah. It's very disturbing. I mean, part of me, like, I give him the benefit of the doubt. Like, the benefit of the doubt would be that he thinks life is like a wrestling show. And that you have to, uh, this is how wrestling people talk. But, uh, and the reality of it is that he just went on a podcast and threatened me.

Speaker: I Marty Bass 20241002 1513_R: right. And there's no, there's no way he could hedge it and go, well, no, that's not what I'm, he said, if I show up, I'm whooping your ass. I know people in North Carolina. All I got to do is make one call. And I got goons at your door. Is that not how you interpret it?

Javier: Yeah, I mean, there's no other way interpret it.

Speaker: Marty Bass 20241002 1513_R: you know, there's no other, you know, they're not showing up with flowers. I mean, you know,

Javier: no, I mean, he said he would knock on my door, pull me out and beat my ass. Right? Like that's what he

Speaker: I wasted no time and reported this episode to Spreaker, his podcast hosting platform, and they took down the episode immediately. Then, then what did David do? He uploaded the episode again. Then continued to produce two more episodes repeating the same threats. both Anthony Christopher and I have filed police reports against David . So once again, Javier, just like you've been doing this whole five months, you've failed. You failed to take down my episode because it's still playing right now. But you failed, then you tried to have this guy who's in your tech top to take down my whole platform failed. What's wrong, Javier? You're jealous. Are you jealous that you got to find people to lie on to make you have a career? TAKEN OFF OF SPREAKER 1ST TIME Javier Leyva could have been convicted. Almost cause Spreaker to get sued. Well, apparently whoever listened to that episode did not listen to the whole thing because I did not in any way threaten him. If you really listen, you will hear me say several times that violence is not the answer. He violated my first amendment rights. I can launch a suit against Speaker right now. For violating my first amendment rights by removing my intellectual property because somebody complained about some speech that I had in it as much as I hate it. And I wish it wasn't true since you accused me of this, but I didn't do it. Hate speech, unfortunately, is also protected by the first amendment. Hi David. It's me, Javier. Let's have a little civics lesson, shall we? Got a second? The First Amendment prevents the government from restricting speech, but it does not limit the actions of a private company. A podcast platform like Spreaker can choose what content to allow and remove A podcast platform like Spreaker can choose what content to allow or to remove based on its policies. And you have the right to say whatever you want, but they don't have to host your hate. Yes, you have the right to say whatever you want. But they don't have to host your hate speech. Get it now? Alright, back to the show If I call this so called church. To go to Eureka Live, I know what the outcome is going to be. If I show up at Javier Labors door, I may go up there all nice, but nice is not going to be in my brain. What I meant by that is, it happens to all of us. Yeah, my intention is to go up there, be nice, say hi to all of you, but then I'm a snap. Did I mention Westboro Baptist Church? Did I threaten to whip Harvey and Labor's ass? Did I threaten to show up at his door and just take him out and beat him down? If you guys can prove I did any of those things, if I just gave you the truth, let me know, and I'll take my whole podcast down. MOVED RSS FEED TO SPOTIFY That's okay, Dave, because I contacted Spreaker again. And this time, Spreaker, the hosting provider, removed your entire podcast. But the man is relentless. David then moved his podcast over to Spotify. I reported it again to Spotify and got the entire podcast taken down again. I reported it to Spotify and got the entire podcast taken down again. David kept moving his podcast until he finally found a hosting provider who had no problems with the threatening content. Captivate. fm responded and told me that this content, quote, doesn't violate our terms and condition, nor does it include any direct threats against you or Anthony. Hmm, unquote, make sure to let the Captivate FM, make sure to let the Captivate. FM people know what you think about their decision WRAP UP So yes, you can still find the We Are Not Afraid podcast. It's out there, but I highly encourage you to refer, but I highly encourage you to restrain yourself, but I highly encourage you, but I highly encourage you to refrain from listening to it. In fact, if you're curious, I included all the best parts in this episode. It's pure garbage. And worst of all, it's a distraction. Because the more that we talk about David McClam or David, or David McCaslin, the less we're talking about LaDonna Humphrey. I will continue my series on LaDonna's surrogates. I have a couple more episodes in the works. And some bonus content. Maybe even an update episode on Oasis. There's a lot of good news happening on that front. So stick around, stay subscribed. If anything major happens with the LaDonna Humphrey case, let's say criminal charges, I will make sure to include it on the main feed, but for now I'm going to keep all the bonus content for the subscribers. We have a lot of cool stories. We have a lot of interesting stories that I want to get to on the main feed. And for those diehard LaDonna haters, they could, uh, go to the, to sub, but for those, uh, diehard anti LaDonna folks that really want to know every detail, you could go to Patreon or Pretend Plus on the Apple podcast or Patreon. com or Patreon plus on Apple podcast. That's it for today. We'll talk. We'll talk again soon
